Stevenson Whelton Successfully Argues Summary Judgment Motion in Aborted Real Estate Transaction

On January 24, 2022, Stevenson Whelton lawyers Wei Jiang and Sukhdeep Gill successfully argued a summary judgment motion for the vendor in an aborted real estate transaction.

On the summary judgment motion, the defendant purchasers advanced multiple defences, including that the transaction was unconscionable, that the vendor was willfully blind, that the contract restricted damages to the forfeited deposits, and that the vendor failed to mitigate its damages. Stevenson Whelton lawyers successfully rebutted each of the various defences put forth.

The Superior Court of Justice ruled in favour of the vendor and awarded it more than $330,000.00 in damages. Read the Decision.
