Stevenson Whelton's lawyers act regularly in large, complex construction litigation, construction lien matters and contractor disputes
As counsel to numerous builder and developer clients, Stevenson Whelton’s lawyers often act for property owners in construction disputes. But we also regularly act for contractors and are well prepared to represent any stakeholder in a construction dispute, including construction lien litigation and Tarion new home warranty disputes.
The Construction Act in Ontario contains a unique and separate court system for resolving certain construction disputes where contractors are entitled lien properties on which they worked. Stevenson Whelton’s lawyers have specific expertise in construction lien litigation, having acted for contractors, subcontractors and owners in a variety of lien disputes. We frequently attend at court on short notice to vacate liens from title where necessary for transactions to be completed.
Stevenson Whelton’s lawyers have also acted for builders in a variety of new home warranty proceedings, including negotiations with Tarion, the administrator of the new home warranty program in Ontario, and formal hearings before the Licence Appeal Tribunal.
