Stevenson Whelton LLP Successful in Trial Concerning Specific Performance of APS for Development Property

Stevenson Whelton LLP lawyers Neil Wilson and Sukhdeep Gill were recently successful in a trial concerning the availability of specific performance of an agreement of purchase and sale for a property purchased for assembly and redevelopment into townhouses.  Stevenson Whelton acted for the plaintiff and obtained an order for specific performance.  The decision is notable for its consideration of the issue of when a property purchased solely for investment or redevelopment purposes can be the subject of an order of specific performance.  A copy of the decision, Kaushal v.
