Stevenson Whelton Successfully Obtains Trial Judgment Removing an Improper Mortgage

Stevenson Whelton lawyer Daniel McConville successfully represented the owner of a commercial property in a trial to remove a mortgage in favour of an old business associate who refused to grant a discharge.  Following a trial, Justice Salmers found entirely in favour of the owner and ordered the mortgage discharged without payment pursuant to section 12(3) of the Mortgages Act.
